Ziggby Fundraising Program Policies

These Ziggby Fundraising Program Policies (“Fundraising Program Policies”) are part of the Fundraising Documentation and are incorporated into the Fundraising Program Agreement and the Fundraising Program Guidelines, that govern your participation in the Fundraising Program. These policies outline the requirements and restrictions that you must follow as a participant. Ziggby reserves the right to make changes to these policies at any time and at its discretion.

 

A. Advertising

 

When promoting or linking to Ziggby, you must not give supporters a false or misleading impression about Ziggby or the program. Additionally, you are prohibited from using keywords, search terms, or other identifiers to drive traffic to Ziggby, including by participating in keyword auctions on search engines or other referral services. Also, you should not include links that redirect users to ziggby.com in any such advertisement.

 

B. Interacting with Ziggby and Ziggby Supporters

 

You will not collect or use any account information from Ziggby supporters, including usernames or passwords. You will not change the way Ziggby functions or create confusion about your relationship with Ziggby. Orders placed through Ziggby may be rejected and will not be eligible for contributions. You will not communicate with supporters and must direct them to contact Ziggby for supporter service issues.

 

C. Forbidden Practices

 

You will not use Ziggby in any way that is harmful or malicious to supporters, including using spyware, malware, viruses, or other malicious code. You will not artificially increase Qualifying Purchases for your fundraiser, and you will not frame or alter Ziggby in any way. You must also not promote Ziggby in pop-up or pop-under windows, transitional page ads, or layer ads. Also, you will not include any Links to Ziggby in any content that you place on Ziggby or any other Ziggby site. Furthermore, you will not hide or obscure the URL of your website containing Links, so that Ziggby can reasonably determine the website from which a supporter clicks through the Link.

 

D. Wishlist Program

 


  1. Participation in the Ziggby Wishists component of the Fundraising Program (the “Wishlist Program) is automatically available when registering for a Fundraising account.  The Wishlist Program is subject to the Fundraising Program Agreement generally and also to this section D (“Wishlist Program Policy”).  With this program, you can submit lists of items that are available through Ziggby, which Ziggby may display on a custom web page or other supporter experiences (“Wishlist Page”) designated for the Wishlist Program. Supporters can then purchase these items on your Ziggby Wishlist and have them delivered to the address (the “Wishlist Address”) designated by your fundraiser.
  2. You need to make sure that the address you provide is a location that you either own or lease. You must also update the address and any other information related to the program immediately if the address changes or if your ownership or leasehold interest in the location ends.
  3. By taking part in the Wishlist Program, you agree to allow Ziggby or any of its partners to share the contact name, email and address you provided for your fundraiser with any supporter that purchases items through Ziggby to send to your fundraiser's Wishlist Address.
  4. You are prohibited from including gift cards, digital items, subscriptions, memberships, fine art, coins & collectibles, or items with a value more than $2,000 in your Ziggby Wishlist.
  5. Items that you receive through the Wishlist Program are not returnable.
  6. The rights, title, and interest in the Wishlist Page, Wishlist Page URL, and information and materials on the Wishlist Page, including intellectual property and proprietary rights, belong exclusively to Ziggby. By participating in the Program, you do not acquire any ownership or rights to the Wishlist Page. You are not allowed to take any action that would conflict with Ziggby's rights to the Wishlist Page. Ziggby has the right to control the content, appearance, functionality, URL and all other aspects of the Wishlist Page, including displaying advertising materials without paying you, and disclosing your participation in the program through text, links, icons or other means.
  7. By agreeing to the Wishlist Program Policy, you give Ziggby a non-exclusive, permanent, worldwide, and royalty-free license to use, copy, reproduce, adapt, distribute, transmit, and display your fundraiser's name, photo, logo, and other trademarks or materials that you provided to Ziggby in connection with the Wishlist Program (including through linking to your Ziggby public profile) (“Fundraiser Marks”) solely for the purpose of promoting, marketing, using, and displaying the Wishlist Program or the Wishlist Page  However, Ziggby will not change any of the materials you provided (except to make them fit the style, format, or size of the promotional materials or Wishlist Page as long as the overall presentation of the materials remains similar.)
  8. All Wishlist Pages are considered Ziggby Services according to Section 12 of the Fundraising Program Agreement, and you are responsible for all content and data (including the Fundraiser Marks) that you provide in connection with the Wishlist Program. This also means that you are subject to the waivers and indemnity obligations outlined in Section 6 of the Fundraising Program Agreement.
  9. If there is any area in the United States where your fundraiser is required to register to solicit contributions or meet any similar administrative requirement under applicable law, but your fundraiser is not registered, you must inform Ziggby of such areas (“Excluded Jurisdictions”). Ziggby reserves the right to not show your Ziggby Wishlist to supporters in those Excluded Jurisdictions and you should not market your Ziggby Wishlist to anyone or any entity within those Excluded Jurisdictions.
  10. Ziggby has the right to end or pause your participation in the Wishlist Program at any time, for any reason or no reason, by providing you with written notice of suspension or termination. Similarly, you have the ability to end or pause your participation in the Wishlist Program at any time by deleting all Ziggby Wishlists associated with your Fundraising account.

Occasionally, Ziggby may ask you to provide information to confirm that you are following the Fundraising Program Agreement or any Fundraising Documentation, including if you still qualify as a Registered Fundraiser. You must cooperate with Ziggby and promptly provide the requested information. When asked, you must provide Ziggby with written certification that you have complied with the Fundraising Program Agreement, including all Fundraising Documentation. Additionally, you agree to allow Ziggby to monitor your website to confirm compliance with the Fundraising Agreement, and you will give Ziggby copies of Content on offline versions of your website if requested. Also, you agree to allow Ziggby to monitor and use information about its supporters in relation to their use of the Links and Ziggby.
